The American continent is one of the privileged territories in terms of biodiversity and natural resources, which are threatened due to their exploitation and management without a vision of sustainability. In the case of the Republic of Colombia, the Greater Caribbean region is undergoing degradation of its marine environment due to the construction of large infrastructures by third-party coastal States. For this reason, it requested an advisory opinion before the Inter-American Court of Human Rights, which in its decision opened the door to the recognition of a healthy environment and its link to human rights. An explanation is given of the cases in which advisory opinions operate and their effects. The case is also described and a critical evaluation is made, raising the challenges and possibilities of its application in American law.
