The Diploma aims to develop the main topics related to judicial governance, administration and reform of justice, through the theoretical study and analysis of the most relevant literature in this field of knowledge.

In addition, it will provide theoretical knowledge and practical skills for understanding the administration of justice, organizational models of justice and judicial ethics.

General information

What will participants learn?

  • Participants will acquire the necessary knowledge on Judicial Governance, Administration and Reform of Justice, as well as its relationship with the different areas of Public Management.
  • Participants will apply the normative, conceptual and practical tools necessary to reason and decide ethically in the field of the administration of justice.
  • Participants will learn the fundamental features of the realist theory of law.
  • Participants will correctly handle the principles of cost-benefit analysis.
  • Participants will apply attitudinal analysis to anticipate judicial decisions.
  • Participants will evaluate transaction costs and economic profiles of property and damage.
  • Participants will identify the philosophical and doctrinal foundations of jurisdiction and its place in democracy and contemporary constitutionalism.
  • Participants will study government and judicial administration and its main problems in the Ecuadorian and regional context.
  • Participants will analyze the main jurisprudence of the Constitutional Court on due process, effective judicial protection and precedent.

Aimed at

  • Lawyers and professionals who occupy managerial or leadership positions, senior corporate executives and/or senior government officials.
  • Legal professionals working in the private or public sector.
  • Professionals with experience in the area of law or related disciplines.

Profile of graduates

  • Covering the 80% of assistance per unit.
  • Obtain a minimum passing grade of 70.
  • At the end of the program, the participant will receive a Diploma endorsed by the University of Genoa (Italy) and the Universidad Espíritu Santo (Ecuador), for having successfully completed the Diploma.

Unit 1. Judicial Government, Administration and Reform of Justice. 

  • Procedural Reform in Ibero-America.
  • Judiciary, Judicial Independence and Democracy.
  • Theory of Judicial Administration.
  • Effective Judicial Management, Artificial Intelligence and Justice 4.0.
  • Models of judicial organization.
  • International and Comparative Judicial Law.
  • Judicial Production and Design of Judicial Statistics.

 

Unit 2. Applied Judicial Ethics

  • Judicial ethics as part of applied ethics.
  • Standards of conduct and standards of competence.
  • Independence, impartiality and motivation.
  • Ethical theories.
  • Judicial Ethics and Difficult Cases.
  • Judges' Models.
  • Judicial Deontology: the legal duty and the ethical duty of the judge.
  • Ibero-American Code of Judicial Ethics.

 

 

Unit 3.  Theory of Judicial Law, Legal Realism and Economic Analysis of Law.

  • American legal realism, the Progressives, and the origins of economic analysis.
  • Practical rationality.
  • Law and Economics - Overview and basic notions.
  • Efficient allocation of resources: Coase theorem; transaction costs and property rights.
  • Efficiency and cost-benefit analysis.
  • Kaldor-Hicks criterion; wealth maximization. Efficiency, effectiveness, efficiency of the law.
  • Equity and welfare.
  • Tort law: external and internal liability rules.
  • Weighting and cost-benefit analysis.
  • Analysis behavioral.
