What is Mediation?

It is a voluntary, confidential and extrajudicial procedure, by which the parties, assisted by a neutral third party called mediator, try to find a definitive solution to a conflict.

The Minutes of the Total Mediation Agreement reached by the parties shall constitute an enforceable title with force of final judgment and res judicata.

The mediation hearings may be in person or telematically, in any part of the national and international territory.

In 2021, 94% of the mediation requests promoted in our Center achieved a total agreement, which demonstrates proven effectiveness in resolving conflicts without the need for ordinary courts.

Who is involved in Mediation?

The mediation process involves:

  • The Parties. They are natural or legal persons who have a conflict in common. It is not essential to have a lawyer to go to mediation.
  • The Mediator. An impartial third party whose function is to facilitate communication between the parties involved in a conflict, so that the parties can find an alternative that allows them to reach an agreement to resolve their dispute.

Who can request a Mediation?

All natural or legal persons, public or private, legally capable of settling, without the need for the sponsorship of a lawyer. The State or public sector institutions may submit to mediation, through the person empowered to contract on behalf of the respective institution.

When can I access Mediation?

  • When there is a written agreement between the parties to submit their conflicts to mediation.
  • At the request of the parties or one of them.
  • By judicial referral.

How is the Mediation process at CAMUEES?

  1. Submit a request for mediation to the UEES CAM, in person or online, to the Director of the UEES Arbitration and Mediation Center.
  2. Appointment of Mediator.
  3. Notification to the parties of the date and time for the hearing (maximum 2 working days).
  4. Commencement of the mediation hearing at the designated date and time.
  5. Agreement between the parties.
  6. The process concludes with the signing of the Record of Total Mediation Agreement, Record of Impossibility of Mediation, or Record of Impossibility of Settlement.
